NILU AGRAWAL ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the police personnel is that on a secret tip off that a motorcycle loaded with wine is arriving. The police personnel apprehended the motorcycle driver and seized 40 liters of country made wine.

It has been submitted by the learned counsel for the petitioner that he is innocent, nothing has been recovered from his conscious possession and there is no criminal antecedent. He submits that he is in custody since 10.03.2017 and that charge

Patna High Court Cr.Misc. No.25850 of 2017 (2) dt.04-07-2017 2/2 sheet has already been submitted, hence there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstance of the case and materials on record , let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S.Case No. 49 of 2017.
