The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

9 liters of liquor was allegedly recovered from possession of the petitioner. The petitioner has got identical criminal antecedent. The petitioner is in custody since 25.01.2021. Investigation of the case is already complete. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below

Patna High Court CR. MISC. No.23490 of 2021(2) dt.07-09-2021 2/2 where the case is pending in connection with Excise Case No.89 of 2021, arising out of Chand P.S. Case No. 10 of 2021, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) If the Court-below would come to the notice that the petitioner is indulging in identical offence that would be a ground for cancellation of bail in this case also by the Court-below itself.
