The petitioner is an accused of Rajapakar P.S. Case No. 206 of 2014 registered under section 308 and other allied sections of the IPC. The allegation is of assaulting the informant on his head causing injury simple in nature which again is said to have been caused by hard and blunt substance.

The prayer for anticipatory bail has been disposed of by the learned Sessions Judge considering the submission that the petitioner was extended the benefit of section 41(1) Cr. P.C. as injuries were not found substantial in nature. The counsel for the petitioner states that in view of 2004

(3) PLJR 491, the petitioner shall surrender and seek regular bail from the learned court below. The impugned order of the learned
