2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 409, 420 and 504 of the Indian Penal Code.

3. As per prosecution case, this petitioner was Ward Secretary of the Ward Implementation and Management Committee and allegation against him is of embezzlement of government money under the scheme of Mukhya Mantri Sat Nischay Yojna.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is not named in the F.I.R. and the F.I.R. was lodged against Ward Member, namely Abdul Rahim Ansari. He further submits that the entire amount of the scheme was transferred in the account of son of the informant

Patna High Court CR. MISC. No.15953 of 2024(2) dt.14-03-2024 2/2 by cheque and only with a view to save the skin of his son this false and concocted case has been lodged and this petitioner has falsely been implicated in this case. Petitioner claims clean antecedent.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that at the relevant time, petitioner was Ward Secretary of the Ward Implementation and Management Committee and allegation is of not completing the work of Ward No. 7 of Gram Panchayat Raj Parihar North though Rs. 20,10,000 was transferred into the account of the Ward Implementation and Management Committee but work of only Rs. 12,65,000/- were made and the whole amount was withdrawn.

6. Considering the aforesaid facts and circumstances and nature of allegations, the prayer for grant of anticipatory bail to the petitioner is rejected.
