Petitioner, already in custody, seeks bail in connection with Bhagwanpur P.S. Case No.145 of 2017, registered under Sections 341, 323, 325, 307 and 302/34 of the Indian Penal Code.

Allegation in brief is that due to dispute relating to construction of the house, the petitioner is said to have given a farsa blow over the head of the mother of the informant as a result succumbed to the injury.

Learned counsel for the petitioner submits that there is case and counter case between both sides and there was no intention of the petitioner to kill the mother of the informant.

Patna High Court Cr.Misc. No.14609 of 2018(2) dt.14-03-2018 2/2 Having considered the specific accusation against the petitioner as a result of assault the mother of the informant died, the prayer of bail of the petitioner is rejected in connection with Bhagwanpur P.S. Case No.145 of 2017, pending in the court of learned CJM, Kaimur at Bhabua.
