JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-01-2022 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered in connection with Kusheshwar Asthan P.S Case No. 254 of 2020 for the offences punishable under Sections 147,148,341,323,307,354,504 and 506/34 of the Indian Penal Code.

As per prosecution case, informant's daughter was used to eve-tease by one accused Sunil Paswan. On protest accused petitioners assaulted the informant with Farsa and Saria

Patna High Court CR. MISC. No.23514 of 2021(3) dt.07-01-2022 2/2 and tried to outrage the modesty of informant's daughter. It is submitted on behalf of the petitioner that there is a case and counter case between the parties. Petitioners assaulted the informant and she sustained injuries on her head which is caused by hard and blunt substance, simple in nature. It appears from the F.I.R that no case under section 307 and 354 of the Indian Penal Code is made out against the petitioners In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S Case No. 254 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
