2. The petitioner has preferred this application for grant of regular bail in connection with Neora P.S. Case No. 210 of 2024 dated 31.10.2024 registered for the offences punishable u/ss 126(2), 115(2), 109, 352 read with section 3(5) of the BNS.
3. As per the prosecution case, the petitioner and the co-accused persons came to the house of the informant and started abusing and assaulting her. When her nephew came to rescue, all the accused persons also assaulted him causing severe injuries, thereafter they fled away.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.14920 of 2025(2) dt.22-03-2025 2/2 this case. There is general and omnibus allegation against the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner. The specific allegation against the co-accused Hardayal Kumar and Ravi Kumar of assaulting the informant's nephew with the butt of pistol. There is case and counter case between the parties. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 08.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the injured sustained two grievous injuries.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Neora P.S. Case No. 210 of 2024.
7. The application stands allowed.
