ANJANA MISHRA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 227(C) of 2016 for the offence registered under Sections 323/419/420/467/468/504/506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that only on account of certain fake and false story created by the complainant, the petitioner is apprehending his arrest. It is further submitted that three types of story regarding taking money from the complainant has been made in the complaint petition itself, one at Buxar and the other at Lakhsarai and also at Mugalsarai. It
Patna High Court Cr.Misc. No.16395 of 2018 (2) dt.06-04-2018 P2/ is also submitted that on one hand it is alleged that the petitioner took money for getting him admitted in M.S. Ramadhya Institute of Technology whereas at another point of time he has alleged extortion of money by the petitioner.
Considering the divergent stories built up by the complainant, which cast a serious cloud in the prosecution story, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai, in connection with Complaint Case No. 227(C) of 2016, subject to the condition as laid under Section 438(2) Cr.P.C.
