JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with respect to Raj Kishore Chaudhary petitioner no. 2, as during pendency of this case, petitioner has already been arrested. Prayer is allowed. The anticipatory bail application with respect to petitioner no. 2 is dismissed as withdrawn having become infructous.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends her arrest in Bachhwara P.S. Case No. 176 of 2021, registered for the offences punishable under Sections 406, 420, 504, 506, 34 of the Indian

Patna High Court CR. MISC. No.14926 of 2022(2) dt.23-08-2022 2/2 Penal Code.

As per the prosecution case, petitioner no. 1 is alleged to have humiliated the informant and her father-in-law and denied to sell the alleged piece of land.

It is submitted that there is no allegation of any overt act against petitioner no. 1. and she has been made accused in this case because she is wife of co-accused Raj Kishore Chaudhary. Petitioner is a lady and claims clean antecedent. Considering the facts aforesaid, Kumkum Devi petitioner no. 1, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 176 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
