Petitioner, already in custody, seeks bail in connection with Azimabad P.S. Case No.51 of 2015, registered under Sections 364/34 of the Indian Penal Code. Later on Sections 302/201 of the Indian Penal Code were added.

Allegation in brief is that while informant was coming along with his father then all accused persons on the way caught hold his father and assaulted indiscriminately with lathi and brick-bats as a result he died.

Learned counsel for the petitioner submits that the postmortem report reveals no external injury on the person of the deceased and cause of death is strangulation and similarly situated co-accused Manoj Choudhary and Gabbar Chaudhary

Patna High Court Cr.Misc. No.10335 of 2018(2) dt.21-02-2018 2/2 and others have been admitted to bail by different coordinate Benches of this Court by order dated 07.04.2016 and 10.02.2017, passed in Cr. Misc. No.6506 of 2016 and Cr. Misc. No.2900 of 2017 respectively.

Having considered the said facts and circumstances, petitioner Nandu Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur, Ara in connection with Azimabad P.S. Case No.51 of 2015.
