JUSTICE SHIVAJI PANDEY ORAL ORDER 08-01-2021 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. In this case, the petitioners are seeking anticipatory bail in connection with Jandaha P.S. Case No.1 of 2020, registered for the offence under Sections 304(B)/34 of the Indian Penal Code.
The petitioners are father-in-law and mother in law of the deceased. The daughter of the informant was married to Sonu Kumar three years ago and after some time she gave birth to a female child. Allegation has been made against the accused persons including these petitioners that they have killed the daughter of the informant by strangulation.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.12730 of 2020(4) dt.08-01-2021 2/2 petitioners are old persons and at the same time, the husband of the deceased is in jail.
Learned counsel for the informant submits that such an act cannot be done by one person, all the family members have jointly killed the victim by strangulation, which is supported from the postmortem report.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected.
