The petitioner seeks regular bail in connection with Parbatta P.S. Case No. 471 of 2018 registered for the offence punishable under Sections 21 and 22 of the N.D.P.S. Act. The allegation is regarding recovery of 42 grams of Ganja from the petitioner herein when he was apprehended by the Police.

The learned counsel for the petitioner submits that the recovered Ganja comes under small quantity under the Schedule to the N.D.P.S. Act, 1985, hence the petitioner can be released on bail without complying with the provisions of Section 37 of the N.D.P.S. Act. It is further submitted that though the petitioner is accused in two other cases but he is on

Patna High Court CR. MISC. No.13237 of 2019(2) dt.05-03-2019 2/2 bail in the said two cases. Lastly, it is submitted that the petitioner is languishing in custody since 18.12.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khagaria in connection with Parbatta P.S. Case No. 471 of 2018.
