Petitioner, in the present case, is seeking regular bail in connection with Brahampura P.S. Case No. 82 of 2017, registered for the offences punishable under Section 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that of fleeing away with a truck which was stolen. Learned counsel submits that in fact the petitioner was working as a driver on truck bearing Registration No. U.P 44T-0115 which belongs to one Santosh, when this petitioner was arrested the said Santosh denied his being the owner of the truck. Learned counsel further submits that although
Patna High Court Cr.Misc. No.32727 of 2017 (2) dt.20-07-2017 2/2 the petitioner is named in two more cases under Section 379 IPC, however, in those cases he was made accused on the basis of confessional statement of co-accused and in both the cases he is on bail. Learned counsel further submits that the investigation in the present case is over and charge-sheet has already been submitted. Learned A.P.P. for the State opposes the prayer for bail.
In the facts and circumstances of the case, let the petitioner, above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura P.S. Case No. 82 of 2017, subject to the conditions under Section 437(3) of the Cr.P.C.
