This application has been filed for grant of bail in connection with POCSO Case No.11 of 2016 arising out of Sherghati (Dobhi) P.S.Case No.301 of 2015 dated 17.11.2015 (G.R.No.1683 of 2015), registered for the offences under Sections 366A and 34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 10.5.2017 passed in Cr. Misc. No.22486 of 2017 with an observation that the learned trial court shall expedite the trial of the petitioner and try to conclude it within a period of one year.
Submission of the learned counsel for the petitioner is that at that time, the learned counsel for the petitioner could not make some submission regarding medical report and other report as well
Patna High Court Cr.Misc. No.32134 of 2017 (2) dt.12-07-2017 2/2 as statement under Section 164 Cr.P.C., as such he has made second attempt for bail.
From perusal of the record it appears that earlier the prayer of the petitioner had been rejected by this Court vide order dated 10.5.2017 passed in Cr. Misc. No.22486 of 2017 with direction to the court concerned to expedite the trial and try to conclude it within a period of one year. In such view of the matter, I am not going to consider the prayer for bail of the petitioner on merit again.
As such, this application is dismissed.
