Petitioner is apprehending his arrest in connection with Shashtri Nagar P. S. Case no. 323 of 2014 registered under Sections 341, 323, 147, 307, 149 and 325 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegation against the petitioner is on the basis of conjecture and admittedly, the informant is not the eye witness to the occurrence. Learned counsel for the informant, however, has pointed out that petitioner is nephew of the main accused person and he had actively participated in the occurrence which was communicated to the informant by the injured himself. He further submits that petitioner, being the named accused, may not be permitted to take advantage of anticipatory bail specially in view of the fact that he has several criminal antecedents. Considering the aforesaid submissions, I am not inclined

Patna High Court Cr.Misc. No.17792 of 2015 (2) dt.10-09-2015 2 / 2 to grant anticipatory bail to the petitioner. Accordingly, this application is rejected.
