The petitioner seeks bail in a case registered under Sections 399, 402 of the I.P.C. as well as Sections 25(1-b) (a)/26/35 of the Arms Act and 20/22 of N.D.P.S. Act. Allegation is that 500 gram charas is recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.6.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 500 grams charas is recovered from co-accused Md. Sameer. There is no recovery from the conscious possession of the petitioner. There is no compliance of Sections 42 and 50 of N.D.P.S. Act. Other co-accused has been granted bail vide Cr.Misc.No.37478

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge III-cum-Spl. Judge, C.B.I. II, Patna in connection with Spl. Case No.35A of 2018 arising out of Khusrupur P.S. case No.78 of 2018.
