2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 147, 148, 149, 323, 341, 342, 302 and 201 of the Indian Penal Code . 3 . As per the prosecution case , 15 F.I.R. named accused persons and 10 unknown accused persons including this petitioner attacked the Baarat and assaulted the informant and his son. Later on, when the informant searched for his

Patna High Court CR. MISC. No.13777 of 2025(2) dt.11-04-2025 2/3 handicapped son, he could not find him and the police were informed. Thereafter, dead body of handicapped son of the informant was found in the river. It is alleged that all the accused persons killed the son of the informant.

4. Learned counsel appearing for the petitioner submits that petitioner has falsely been made accused in this case only on the basis of suspicion . Informant is not eye witness to the alleged occurrence . Allegation is general and omnibus in nature . No specific overt act has been alleged against this petitioner. Co-accused persons having identical allegations have already granted pre -arrest bail by this Court vide order dated 08.05.2024 in Cr. Misc. No. 24343 of 2024 . Charge sheet has already been submitted. Petitioner is in custody since 10.09.2024 .

5 . Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial
