JUSTICE ALOK KUMAR PANDEY ORAL ORDER 18-03-2026 This application has been filed for modification of the order dated 07.10.2025 passed in Cr. Misc. No. 70630 of 2025 seeking extension of time for furnishing bail bonds of the petitioner.
2. Learned counsel for the petitioner submit that petitioner has already been granted privilege of anticipatory bail vide order dated 07.10.2025 passed in Cr. Misc. No. 70630 of 2025. He further submits that the petitioner failed to appear before the concerned court and furnish bail bonds within the stipulated period of six weeks. Learned counsel orally submits that there was no intention or deliberation on the part of the petitioner to flout the order passed by this Court. He further submits that petitioner was out of State and he was not intimated
Patna High Court CR. MISC. No.16509 of 2026(2) dt.18-03-2026 2/3 regarding the direction of this Court and hence, delay has been caused. Thereafter, petitioner managed to return home on 23.12.2025. Learned counsel further submits that due to said reason, the petitioner failed to furnish bail bonds within the stipulated period of time and now, learned counsel prays that the time for furnishing bail bonds may be extended by another six weeks from today.
3. Learned Additional Public Prosecutor appearing for the State has no objection over the same.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the time for furnishing bail bonds by the petitioner is extended by another six weeks from today, on same terms and conditions as stipulated in order dated 07.10.2025 passed in Cr. Misc. No. 70630 of 2025, in connection with Dumariya P.S. Case No. 91 of 2024 to the satisfaction of learned Exclusive Excise Judge No. 3, Gaya.
5. Accordingly, order dated 07.10.2025 passed in Cr. Misc. No. 70630 of 2025 is modified to the extent stated above.
6. The present modification application, accordingly, stands allowed.
