The petitioner seeks bail in Sessions Trial No.418 of 2017 arising out of Bhagwanpur P.S. case No.101 of 2009 registered under Sections 341, 324, 307/34 of the Indian Penal Code, pending in the court of 4th Additional District & Sessions Judge, Siwan. Later on, Section 302 of I.P.C. has been added. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the husband of the deceased. A report was called for from the court below regarding the stage of trial. It has been reported that the trial is expected to be concluded within a period of nine months. Considering the nature of accusation and the stage of
Patna High Court CR. MISC. No.15432 of 2019(5) dt.02-08-2019 2/2 the trial, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order. The District Magistrate, Siwan and the Superintendent of Police, Siwan are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
