The petitioners apprehend their arrest in a case registered for offences punishable under Sections 147/148/149/341/323/307/385/427 of the Indian Penal Code. As per allegation the petitioners and others tried to extort money on the pretext of 'Sarswati Puja' and altercation took place on that count. Thereafter, they stopped the bus and started assaulting by pelting stones and bricks and it is also alleged that they took away Rs. 2500/- and mobile phone of the conductor. The injuries are stated to be simple in nature. It is further contended on behalf of petitioner that the petitioners are

Having regard to the facts and circumstances of the case, let the petitioners, namely, Dhirendra Singh, Langara Singh Langara alias Deepak Singh and Dhiraj Tiwary be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Bhabhua P.S. Case No. 101 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhabhua subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that one of the bailors of the petitioners must be a close relative or family member of the petitioners who shall file affidavit before the concerned court giving complete genealogy to show their relationship with them.

However, in view of nature of the case, they would be required to appear before the Superintendent of Police, Bhabhua within fifteen days of their release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioners will be kept under watch during the aforesaid period by the Superintendent of Police concerned and if

No.11799 of 2016 (3) dt.08-04-2016 3/3 it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail. After reporting to the Superintendent of Police, a certificate will be filed by the petitioners before the court concerned which should be granted by the Superintendent of Police upon their appearance. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
