JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Forbesganj P.S. Case No. 307 of 2017 registered under Sections 379 and 411 of the Indian Penal Code.

Accused persons, namely, Raj Kumar Mandal and Shashi Kumar Mandal are said to have stolen the motorcycle of the informant and the said motorcycle was recovered from the garage of the petitioner.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner runs a garage and he happens to be a mechanic of the motorcycle. Coaccused persons brought the motorcycle in his garage for repair

Patna High Court Cr.Misc. No.32421 of 2017 (2) dt.13-07-2017 2/2 and in the meantime, the said motorcycle was recovered from his garage. He has no concern with the aforesaid offence. The petitioner has been languishing in custody since 15.05.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 307 of 2017.
