ANJANA MISHRA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Chauradano P.S. Case No.05 of 2015 for allegedly having committed the offences under Section 376/511 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case on account of a land dispute in which the family of the both informant and the petitioners claim to be the purchaser of the land in question.
Considering the aforementioned submissions and the
Patna High Court Cr.Misc. No.20257 of 2015 (2) dt.02-07-2015 2/2 nature of allegations and also the fact that the petitioners have no criminal antecedents, let both the above named petitioners, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Chauradano P.S. Case No.05 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
