The petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Considering the seriousness of the matter, vide order dated 06.09.2021 a report was called for in this case from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial along with the case diary.

In compliance thereof, a report dated 17.09.2021 sent by the learned Additional Sessions Judge-IX, West Champaran at Bettiah has been received, which is at Flag 'R' to this application. The learned Judge in his report has, inter alia,

Patna High Court CR. MISC. No.24365 of 2021(3) dt.28-10-2021 2/2 submitted that out of seven charge-sheet witnesses only two witnesses has been examined and the trial could be concluded within six months.

Having heard learned counsel for the parties and pursuing the case record as well as the case diary, I am not inclined to grant the privilege of bail to the petitioner. The prayer for bail is hereby rejected.

However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within six months from the date of receipt/production of a copy of this order. Both the parties are expected to extend their full cooperation in conclusion of the trial. (Anjani Kumar Sharan, J) Trivedi/- U
