The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Liquor was recovered from an Alto car and the petitioner was there in the said car. Petitioner has got identical criminal antecedent.

In the past, prayer for bail was refused vide order at Annexure-1 with liberty to the petitioner to renew the prayer for bail after completion of nine months of custody. Petitioner is in custody since 26.06.2020.

Considering the aforesaid facts, let the petitioner,

Patna High Court CR. MISC. No.25334 of 2021(2) dt.15-09-2021 2/2 above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No. 4103 of 2020 arising out of Bihta P.S. Case No. 451 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
