This application for regular bail arises out of Bihariganj P.S. Case N0. 175 of 2018, (Excise Case No. 471 of 2018), disclosing offences under Section 30(a) of the Bihar Prohibition and Excise act, 2016.

The petitioner has criminal antecedent as is evident from paragraph 3 of the application.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has remained in custody for nearly one year. The petitioner's implication is based on the disclosure made by co-accused Dinesh Murmu in his confessional statement before the police. It is being argued that there is no recovery of any illicit liquor from the petitioner's possession.

Considering the facts and circumstances, this

Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge Excise Act, Macdhepura in Bihariganj P.S. Case No. 175 of 2018 (Excise Case No. 471/2018).
