2. The petitioner has not filed any discharge application in the trial Court and he has approached this Court against the order framing charge.

3. It appears that the petitioner was not vigilant enough, he should have filed an application for discharge, if he says that there is no material against him.

4. In these circumstances, this Court will not interfere in the order framing charge.

5. This application is dismissed with a liberty to the

Patna High Court CR. MISC. No.21119 of 2024(2) dt.05-08-2024 2/2 petitioner to file an application at the appropriate stage for alteration of charge.
