JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2017 The petitioner seeks regular bail in connection with Chainpur P.S. Case No. 77 of 2017, registered for offences punishable under Sections 467, 468, 406 and 420 of the Indian Penal Code.
Allegation against the petitioner that he on the pretext of providing Rs. 50,000/- to the informant and other villagers and received Rs. 560/- as a membership from them and provided a cheque of Rs. 50,000/-, however, on production, cheques were found to be forged one.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case, which will appear from the fact that though there is allegation that petitioner issued 93 cheques in their favour, however, they did not disclose this fact at
Patna High Court Cr.Misc. No.30991 of 2017 (3) dt.24-07-2017 2/2 the time of receiving the cheque but later on with an ulterior motive have made this false allegation. Further petitioner has no criminal antecedent and has been in judicial custody since 28.04.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is accordingly rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible, preferably within a period of nine months.
