The petitioner seeks regular bail in Sonepur (Hajipur) Rail P.S. Case No.30 of 2016 for the offence under Section 414 of I.P.C. and Sections 20, 22 of N.D.P.S. Act.

Earlier prayer for bail of the petitioner has already been rejected on merit vide order dated 22.02.2017 passed in Cr.Misc.No.7844/17 with direction to the trial court to conclude the trial within a period of three months.

Petitioner has again filed the present petition for bail. Heard learned A.P.P. also.

In this case a report was called for from the court of Additional Sessions Judge-1, Vaishali, as well as the Rail S.P.,

Patna High Court Cr.Misc. No.33851 of 2017 (3) dt.23-08-2017 2/2 Muzaffarpur, from which it appears that so far four prosecution witnesses have been examined in this case. The trial court has assured that the trial will be concluded within a period of four months provided the parties cooperate in the trail. In such view of the matter, at this stage, I am not inclined to grant bail to the petitioner. However, the trial court is directed to expedite the trial by conducting day to day basis and at the same time the S.P., Rail,Muzaffarpur, is also directed to ensure attendance of the remaining witnesses.

With the aforesaid observation, this petition is dismissed.
