Sahay, learned counsel for the petitioner and Dr. Indiwar Kumari, representing the State. In this case, the petitioner is seeking bail in connection with Chautarwa P.S. Case No. 158 of 2005 registered for offences under sections 364A/34 of the Indian Penal Code.

The prosecution story in short is that altogether four laborers had gone to Tamkuhi Sareh to bring bundles of paddy but, in the meantime, six accused persons, having arms in their hands, surrounded them and, thereafter, abducted them and proceeded towards the orchard. After interrogation, they left two of the abducted persons who disclosed the name of the miscreants, led to institution of the present case.

Patna High Court CR. MISC. No.20415 of 2020(4) dt.04-12-2020 2/2 This case is of the year 2005 and the petitioner was was arrested on 11.10.2019 and, thus, he remained absconding for about 14 years.

Learned counsel for the petitioner submits that the petitioner was not absconding rather he was having no knowledge about institution of the present case. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a liberty to renew his prayer for bail after six months.
