The petitioners, four in number, apprehend their arrest in Bathnaha P.S. Case No. 218/13 registered under Section 307 and other sections of the Indian Penal Code. The informant alleged that Tek Narayan Rai and Amresh Rai came to his wine shop and took two bottles of wine without paying money. They again came and demanded wine; on refusal, they assaulted the informant. It is alleged that on alarm the petitioners and others came and looted money and wine from the wine shop of the informant. It is submitted that there is a counterversion being Bathnaha P.S. Case no. 217/2013. It appears that there is no specific allegation of
Patna High Court Cr.Misc. No.11793 of 2016 (3) dt.23-06-2016 2/2 assault against the petitioners.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S.
