2. The petitioner, who is in custody since 27.08.2017, has renewed his prayer for bail in connection with Trial No. 3523 of 2017 arising out of Chanpatia P.S. Case No. 250 of 2016 having earlier been rejected by order dated 13.11.2017 in Criminal Miscellaneous No. 51542 of 2017.

3. It is submitted that while the earlier bail petition was rejected, however, liberty was granted to the petitioner to renew his prayer for bail after framing of charge which has since been done on 03.01.2018 (Annexure-3)

4. Be that as it may, having regard to the entirety of the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judical Magistrate-V, West Champaran, Betiah, in connection with Trial No. 3523 of 2017 arising out of Chanpatia P.S. Case No. 250 of 2016, on the following conditions:-

Patna High Court Cr.Misc. No.4329 of 2018 (2) dt.14-03-2018 (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
