2. The petitioner has preferred this application for grant of regular bail in connection with Parasbigha P.S. Case No. 256 of 2024 dated 19.11.2024 registered for the offences punishable u/ss 8/20(b)(ii)B of the N.D.P.S. Act, Section 30(a) of the Bihar Prohibition and Excise Amendment Act and Section 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, total 35 litres of illicit country-made liquor was recovered in front of the house of the petitioner and total 3.500 Kg ganja, 30 litres of illicit countrymade liquor, Rs. 32,000/- in cash, one country-made gun and a pistol were recovered from the house of the co-accused, Lalendra Yadav.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused, Lalendra Yadav. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.12.2024. The co-accused has been granted regular bail by this Court vide order dated 02.04.2025 passed in Cr. Misc. No. 15352 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jehanabad in connection with Parasbigha P.S. Case No. 256 of 2024.

7. The application stands allowed.
