Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 406, 420, 471, 120B of the Indian Penal Code. It is alleged that petitioner being the then Principal of the College misappropriated the amount of the college and collected donation from the people on fake receipt of the college.

It is submitted by learned counsel for the petitioner that though the complaint was filed in the year 1995 and cognizance was taken on 09.10.1996 but the petitioner was not aware about the institution of the present case as with similar accusation police case was lodged in which final form was submitted. The petitioner is aged about 75 years.

Patna High Court Cr.Misc. No.21889 of 2015 (2) dt.25-06-2015 2/2 Considering the fact that complaint was filed in the year 1995 and cognizance was taken on 09.10.1996, this Court is not inclined to grant anticipatory bail to the petitioner. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 84 of 1995, T.R. No. 177 of 2013, pending in the Court of learned Judicial Magistrate, 1st Class, Jhanjharpur.

With the observations above, the application stands disposed off.
