The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act.

It is contended that, as per allegation, 3621 liters of foreign liquor was recovered from the godown of petitioner Bideshi Sharma and the person who was apprehended from the spot disclosed that the godown belongs to the petitioner. It is further contended that the co-accused Ramprabesh Sharma has already been granted bail by a Co-ordinate Bench of this Court

Patna High Court Cr.Misc. No.22797 of 2018(2) dt.19-04-2018 2/2 vide Annexure-2. It is also contended that the charge-sheet/ prosecution report has been submitted in this case. Petitioner claims that he is having clean antecedent and is in custody since 05.02.2018.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Mufasil P.S. Case No. 532 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
