The petitioner seeks regular bail in connection with Kahalgaon PS case no. 465 of 2017 registered for the offence punishable under Sections 461, 379 of Indian Penal Code.

The allegation is regarding theft having been committed by the four named accused persons in the shop of the petitioner and it is stated that various articles were stolen. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, upon disclosure having been made by the son of the informant during the course of investigation, regarding the petitioner using

Patna High Court CR. MISC. No.15304 of 2019(2) dt.26-03-2019 2/2 the stolen laptop in the Tilak ceremony of his younger brother. It is further submitted that no test identification parade of the said laptop has taken place so as to connect the petitioner with the alleged crime. It is further submitted that though the petitioner is not having a good antecedent but he is on bail in the other cases pending against him. Lastly, it is submitted that the petitioner is languishing in custody since 08.10.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-8, Bhagalpur in connection with Kahalgaon PS case no. 465 of 2017.
