JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Roh P.S. Case No.57 of 2015 for the offences instituted under Sections 341, 323, 379, 354, 452, 504 and 506 of the Indian Penal Code and Section 3 (i)(x) of SC/ST Act. The prosecution case, in brief, is that on 17.7.2015 at about 7.00 A.M. the informant's mother Rekha Devi went to the shop then all the accused petitioners were present there and as soon as the informant's mother came out from the shop. Ajit Kumar caught the mother of the informant and started dragging her. The accused Ranjit Kumar, Ratan Singh and Jitendra Singh armed with lathi Danda came there and started assaulting the

On hulla, when the informant came, she has assaulted by Jitendra singh and others with lathi and danda and they also pushed down the informant's sister after catching hold of her hair lock and assaulted with leg and kick. They also committed theft of informant's mobile and silver chain. It is submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. It is a case and counter case between the parties. There is admitted enmity between the parties. No offence under SC/ST Act is attracted in the present case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Sujeet Kumar, J.M. Ist Class, Nawada, in connection with Roh P.S. Case No.57 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) N.H./- U T
