ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Shankarpur P.S. Case No.4 of 2014 for allegedly having committed the offences under Sections 420, 468, 471 and 120B of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioners submits that though there is an allegation against these petitioners that they had applied for appointment on the posts of Panchayat Teacher
Patna High Court Cr.Misc. No.12583 of 2016 (3) dt.10-05-2016 2/2 on the basis of fake certificates, neither have they been appointed nor has any payment been made to them nor have they taken any advantage from the said fake certificates. Learned counsel appearing on behalf of the State submits that actually these petitioners were not appointed, though, on verification, the certificates were found to be fake. However, no advantage was accrued to them from the said certificates.
In view of the aforementioned facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Shankarpur P.S. Case No.4 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
