JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 31.12.2017, seeks bail in connection with Madanpur P.S.Case No. 305 of 2017 registered under Sections 147, 148, 149, 323, 341, 379, 386, 435, 504, 506, 124A of the Indian penal Code and 17 C.L.A. Act. Allegation in brief is that FIR named accused persons along with 30-40 unknown persons came to site of the informant and asked him to stop the work unless levy is paid. Other persons also taken away mobile and other things and two tractors of the informant set on fire.

Submission is that petitioner is not named in the FIR and there is no material against him except confessional statement of co-accused Jai Ram Bhuiyan and petitioner himself made appearance before the police but no witnesses are said to have

Having considered the aforesaid facts and circumstances, the petitioner, namely, Maheshi Bhuiyan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Madanpur P.S. Case No. 305 of 2017.
