This application is for grant of regular bail in connection with Marhourah P.S.Case No.41 of corresponding to G.R.No.605 of 2017, of for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.
The petitioner is husband. The case is of dowry death and the allegation against the petitioner is that he killed his wife and thrown her dead body on the track.
Submission of the learned counsel for the petitioner is that the deceased has committed suicide herself, which will appear from the written report of the Driver of the Train and the witnesses have also stated that during the course of investigation so. Further
Patna High Court Cr.Misc. No.31732 of 2017 (3) dt.03-08-2017 2/2 submitted that the petitioner is in custody since 4.2.2017. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail before the court concerned after framing of charge and the learned trial court will consider entire materials available on the record, he will will also consider the date of marriage and pass appropriate order without being prejudiced by the order of this Court.
With the aforesaid observation, this application is disposed of.
