JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc. No. 55488 of 2016, vide order dated 10.2.2017 with an observation to renew his prayer for bail after framing of charge in this case.
Submission of learned counsel for the petitioner is that charge has been framed in this case and he has not been named in the F.I.R. as the assailant and he is in custody for more than one year.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.6175 of 2018 (2) dt.08-02-2018 2/2 satisfaction of Sri A.N. Jha, District Judge, Saharsa, in connection with Sourbazar (P. ghat O.P.) P. S.Case No. 40 of 2016, corresponding to Sessions Trial No. 133 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in trial and appear before the court below as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
