JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 364/302/201/120B/34 of the Indian Penal Code.
Allegation against the petitioner is that he had conspired from jail along with other co-accused persons as a result whereof murder of Sonu Thakur was committed.
Submission of the learned counsel for the petitioner is that para-13 of the bail petition would reveal that the deceased was himself a man having criminal antecedent and was accused in series of cases under Sections 376/382/302 of the Indian Penal Code.
Patna High Court Cr.Misc. No.21389 of 2017 (4) dt.05-07-2017 2/2 Considering the nature of allegation and lack of sufficient material in the case diary, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra/Successor Court, in connection with Marhaura P.S. Case No.505 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
