The petitioner apprehends his arrest in Dulhin Bazar P.S. Case No. 118/2015 registered under Sections 406, 409, 420, 467, 468, 471 of the Indian Penal Code.
The petitioner was the Panchayat Sachiv of Gram Panchayat Sihi and it was found in the audit report that out of six lacs withdrawn under Scheme No. 01/2011-12, five lacs were defalcated by the Mukhiya and the Panchayat Sachiv (petitioner). Notice was issued to the Mukhiya of Gram Panchayat Sihi, who disclosed that she did not receive any money; rather the Panchayat Sachiv (petitioner) forged her signature and withdrew the entire amount. It is submitted that the petitioner has already retired from service and he is ready to co-operate with the investigating officer. Considering the facts aforesaid if the petitioner
Patna High Court Cr.Misc. No.14271 of 2016 (4) dt.27-06-2016 2/2 deposits five lacs within one month from today, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt / production of a copy of this order, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in Dulhin Bazar P.S. Case No. 118/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
