The petitioners are apprehending arrest in a case registered for the offences punishable under Sections420/467/468/471 of the Indian Penal Code. It is alleged that the land of the informant was transferred by one Amarjit Pandey in favour of Dewanti Devi on which petitioner nos. 1 Sanjay Rai and 3 Babuna Pandey were the witnesses and the identifier whereas petitioner no.2 is the husband of the purchaser Dewanti Devi.
It is submitted by learned counsel for the petitioners that Amarjit Pandey has also filed C. Case No. 1232 of 2014
Patna High Court Cr.Misc. No.17561 of 2015 (2) dt.15-05-2015 2/2 alleging therein that the informant has obtained forged and fabricated sale deed in favour his favour with regard to land of Amarjeet Pandey.
Considering the nature of accusation and the fact that the petitioners are neither the executor of the sale deed nor the beneficiary, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 400 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
