JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Bihpur P.S. Case No. 223 of 2017 instituted for the offence under Sections-38(i)/30(a) of Bihar Excise Act, 2016.

It is alleged that total 10 bottles of 750 ml. and six bottles of 375 ml. Royal Stag foreign liquor have been recovered from possession of the petitioners. It has been submitted that these petitioners are in custody since 06-06-2017. In paragraph-3 of the petition, it has been mentioned that the petitioners have clean antecedent. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.35426 of 2017 (2) dt.01-08-2017 amount each in connection with Bihpur P.S. Case No. 223 of 2017 to the satisfaction of learned Special Judge, Excise Act, Bhagalpur subject to condition that both the bailors should be close relative of the petitioners.
