2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 427, 307, 504/34 of the Indian Penal Code.
3. As per F.I.R., this petitioner assaulted on the head of informant with Salai Rinch.
4. Learned counsel for the petitioner submits that petitioner is father of the informant and has never assaulted him, but on account of family feud, this false and concocted case has been filed. He further submits that As per F.I.R., the alleged occurrence took place on 18.02.2019, but complaint was lodged on 05.12.2019 i.e. after 10 months, which was referred to concerned Police Station under Section 156(3) of the Cr.P.C. and thereafter, F.I.R. was lodged after three years i.e. on 13.12.2022. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the relationship between the parties, delay in lodging the case and clean antecedent, the prayer for anticipatory bail of petitioner is allowed. Accordingly, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Benipur, Darbhanga in connection with Bahera P.S. Case No. 894 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
