02-02-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Petitioners, in the present case, are seeking regular bail in connection with Sadar P.S. Case No. 597/2017 registered for the offence punishable under Sections 561, 379, 411 of the Indian Penal Code. Learned counsel for the petitioners submits that informant in the present case happened to be the Manager of the Godown from where seeds in question were stolen. He further submits that the stolen seeds were recovered on the basis of confessional statement of Md. Kaisher from the house of Md. Mobinuddin. It is further submitted that Md. Kaisher and Md. Mobinuddin have been privilege of regular

Patna High Court Cr.Misc. No.4976 of 2018 (2) dt.02-02-2018 bail by co-ordinate Bench of this Court in Cr. Misc. No. 2758/2018 and Cr. Misc. No. 4027/2018.

Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioners. Considering the facts and circumstances of the case and materials on record, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 597/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
