Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 302, 201, 120(B), 34 of the Indian Penal Code.

It is alleged by the informant that his brother

No.24152 of 2021(4) dt.11-04-2022 2/3 has been killed by his wife along with other in-laws family members since she had illicit relationship with someone which was being objected by the deceased and with a view to disappear the evidence, the dead body of his brother has been hanged with Gamchha on the tree. It is submitted by learned counsel for the petitioner that dead body of the deceased was found hanged with a tree which is six to seven kilometer away from the village of the petitioner. The postmortem report does not suggest any kind of physical assault or any external injury upon the body of the deceased. There is no eye witness to the occurrence and since petitioner is mother-in-law of the deceased, hence, she has been implicated in this case.

In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

No.24152 of 2021(4) dt.11-04-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachhawara P.S. Case No. 167 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
