1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner, after some arguments fairly submits that present quashing application has been filed seeking quashing of the order of cognizance dated 14.09.2015 passed by the learned Chief Judicial Magistrate, Motihari, East Champaran in Motihari Town P. S. Case No.609 of 2013, but during pendency of the quashing application the stage of the case has changed, charges have been framed and the trial has commenced.

3. The learned Additional P. P. vehemently opposes

Patna High Court CR. MISC. No.13839 of 2016(2) dt.05-09-2023 2/2 the quashing application and submits that since charges have been framed and trial has commenced, as such, no useful purpose would be served by quashing the order of cognizance.
