The petitioner has been in custody since 21.10.2017 in connection with Kursakanta P.S. Case No. 61 of 2017 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly, the petitioner is not a family member rather he is brother-in-law of the elder brother of the deceased husband. It is further submitted that the petitioner being remotely connected with the matter and he has no role to play whatsoever. It is further submitted that elder brother of the husband of the deceased has been extended the privilege of bail.

Patna High Court Cr.Misc. No.6289 of 2018 (3) dt.20-02-2018 Having considered the entire facts and circumstances of the case and that the elder brother has already been granted bail by a Bench of this Court passed in Cr. Misc. No. 57725 of 2017 vide order dated 17.01.2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Kursakanta P.S. Case No. 61 of 2017.
