====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 08-09-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 302, 307, 323, 324, 326 and 341/34 of the Indian Penal Code.

Petitioner is in custody since 22.04.2016 and is main assailant of Mahendra Yadav. In the past, prayer for bail was refused on 16.05.2017 with a direction to the trial Judge to conclude the trial preferably within nine months. The report of the trial Judge dated 03.08.2021 reveals that five prosecution witnesses have already been examined in this case and thereafter one of the accused Ramdev Yadav was reportedly dead. For getting information from the local police station regarding death of Ramdev Yadav, the trial is pending.

No.24914 of 2021(3) dt.08-09-2021 2/2 Considering the period already undergone by the petitioner and his readiness to cooperate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jaynagar P.S. Case No. 76 of 2016, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
